I have a clause included in my sales contract that states

“The Buyer agrees that he/she is not acting as or in part of, an agent for the purchase of this puppy/dog and that the Buyer will not sell this puppy/dog or any of its progeny to any agent, mass producing kennel, pet store or guard dog business.”

So yes you should tell the Seller and most of them probably wouldn’t sell to you anyway.

Why not look into doing a deal with your local shelter and re-home pups from there instead? The income from puppy care packs and the good word of mouth advertising would more than make up for any lost revenue. The shelter could display posters for your store and you could have a donation bucket near the till. Everyone wins!!

When you buy a puppy from a REPUTABLE breeder, who really cares for there love of a breed and takes good care of there animals they almost always make you sign a contract saying that YOU will be the dog’s sole caregiver. If you violate this contract they have every right to take the dog, and if you have already sold the dog in your pet store you can be sued. Most pet stores get puppies from puppy mills (which I hope is not what your doing)…. If you get a pup from just any breeder or puppy mill, the dog could be unhealthy, certain breeds are prone to certain things…. you need to further research what your doing… your selling puppies and dogs, there LIVING creatures…. tell me can you tell me you even know if your dogs are going to good homes????? This is just my opinion, I am an owner of many mutts and several purebreds…but I am against selling animals in STORES…. there living creatures.

From what I have heard, most breeders wont even consider selling their pets in a pet store, they are VERY careful about where their pets go, and they cant see that in a store.

I would suggest you go the Petsmart route, and see about displaying pets from a local shelter in your store. That way, those dogs can find homes, and you wont be supporting Puppy mills or BYBs. Everybody wins!

I have a very strict contract. “dog is not for resale”, and “if you can no longer keep or care for said dog, it is to be returned to breeder for rehoming (training first if necessary)”.

You should tell them in my point of veiw or you could go to shelters and rescue puppys to a good home, the ones about to be put down!

Contacting a lawyer in this situation might be your best option. Some breeders have stipulations upon buysing a dog from them that you will not resell the dog, same with rescue organizations or shelters. Its best to get real legal advice about what you can and or should do in order to protect yourself.

If you’re opening a legit business, I think it would be best for you in the long run to ask a lawyer.
If you get bad advise on here, and the breeder finds out you’ve sold their puppy, it’s going to take a lawyer anyway.

What are you talking about? If you want to sell puppies from a pet store, then you need to get them from puppymills. Meaning that you would have to contribute to the over-breeding, mistreatment, abuse, and malnutrition of millions of dogs and puppies in the name of profit.

To answer your question, NO, you can’t lie to breeders about where their puppies are going. They’ll have you sign a contract that states that *you* will be the sole caregiver to that animal, for the rest of its life, and that if for whatever reason you can no longer care for the puppy, it needs to be returned to the breeder.
